PURCHASE WILL NOT INCREASE THE ODDS OF THE ENTRY WINNING
I. Eligibility. The MyItThings.com Best Fall 2008 Fashion
Article Contest (the “Contest”) is only open to legal residents of the United
States (excluding residents of the State of Rhode Island) and Canada (excluding
residents of Quebec), 16 years of age and older. Individuals who are at least 16 years of age
but who are under 18 years of age must have permission from a parent or legal
guardian in order to enter the Contest.
Employees, representatives and contractors of 2 Brains Media, LLC
(“Sponsor”), any affiliated companies, prize suppliers, advertising and promotion
agencies, the immediate family members of such companies (regardless of where
they reside) and individuals living in the same households of each of these
individuals are not eligible. The
Contest is void where prohibited or restricted by law, and is subject to all
applicable federal, state and local laws, rules and regulations. By participating in the Contest through the
submission of an article as described in Section II herein below, you agree to
comply with and be bound by these Official Contest Rules (the “Rules”) and the
decision of the Panel (as defined herein below), administrators and Sponsor of
the Contest, which shall be final and binding in all respects.
II. How to Enter. To
enter the Contest, you must first register to become a member of MyItThings.com
(the “Website”), and confirm your registration via email. For detailed information regarding
registration, please refer to the Website.
Once you have become a registered member of MyItThings.com, you must log
in to the Website in order to submit and post (via your MyItThings.com Personal
Page) under any category an original article (an “entry”) in the English
language of not less than 200 words on the topic of “fall 2008 trends” (as
described below) trends. You must enter the keywords “fall 2008” in the
tags field on the “add post” screen in order to be considered for the contest.
Your article can be about any and all things related to a fall 2008 trends
including fashion (designers, clothing, looks, trends, runway shows, personal
style) and beauty (makeup, hair styles and trends). The article must be written
by you, the submitter, and not anyone else. All articles submitted via
your Personal Page will be deemed to have been written and submitted by
you. Therefore, please maintain your
MyItThings.com log in information as confidential. All articles must be submitted through your
MyItThings.com Personal Page between 12:00 a.m. EST on August 1st, 2008 and
11:59 p.m. EST on September 30th, 2008 (the “Entry Period”). There
is no limit on the number of articles that you are permitted to submit for
consideration in the Contest; provided, however, that each article complies
with the Rules and you may only have one (1) article in the top ten (see
Section III(a) below). Sponsor is not
responsible for any late, lost, misdirected, damaged or incomplete
entries. Immediately upon submission, all articles become the property of
the Sponsor as more fully set forth below and will not be returned. All articles must be original works, never
previously published for commercial gain, and must not be plagiarized, infringe
on any third party’s copyrights or other rights. The article(s) submitted
by you cannot be offensive or inappropriate, as determined by the Sponsor in
its sole discretion. The Sponsor may disqualify articles, without notice,
that it deems, in its sole discretion, to be inappropriate or offensive.
III. Winner Selection & Judging. Winner selection and judging of the articles submitted in the Contest will be carried out in two (2) stages:
(a) During Stage 1 of the Contest, MyItThings.com users will be asked to rate each submitted article on a scale of 1 to 5 stars (1 star being the lowest rating). The voting is IP restricted and requires MyItThings.com registration. Each registered member can vote only once per article during the Contest. The final article score will be calculated from the combination of the total number of votes and the stars rating (i.e. each additional scored star will add 1 point to the total score) for each article. At the end of the Entry Period, all of the ratings will be tallied and the ten (10) articles that received the highest ratings will then proceed to Stage 2 for final judging by a panel of judges. Each user may only have one (1) article in the top ten. If, based upon the star ratings, a user has multiple articles that qualify for the top ten, Sponsor, in its sole discretion, will select the article with the highest star rating to proceed as a finalist to Stage 2.
(b)
In Stage 2, a celebrity panel of three (3) judges chosen by the Sponsor (the
“Panel”) will review each of the ten (10) finalist articles. The ten (10) final articles will be scored
based on the application by each judge of the following criteria: (i) subject originality – 30% of total score, (ii) author’s
point of view – 30% of total score, (iii) creative writing ability– 20% of
total score, (iv) informative value – 10% of total score, and (v) the “IT”
factor – 10% of total score. Among the ten (10) final articles, the Panel
will select one (1) winning article, whose author will be awarded the Grand
Prize. In the event of a tie, the article scoring highest in the “subject
originality” category will be awarded the Grand Prize. Finalist judging
will be complete by October 10th, 2008.
As set forth above, the decision of the Panel is final and binding. All potential prize winners must fulfill the
obligations set forth in Section V herein below.
IV. Odds of Winning. The odds of winning depend on several factors including, but not limited to the number of eligible entries received during the Entry Period, the number of votes received from registered members, and the quality of the entries submitted, as determined by the panel of judges.
V. Notification of Prize Winners. On or about October 11th, 2008, the potential prize winners will be notified by Sponsor via email to the email address listed in his/her MyItThings.com account. The return of any prize notification or prize as undeliverable or any other non-compliance with these Rules, as determined by the Sponsor, may result in the forfeiture of the applicable prize. Prior to receiving a prize, the potential prize winner will be required to execute an Affidavit of Eligibility and Liability Release, IRS Form W-9, and where legal, a Publicity Release, all of which must be returned within fourteen (14) days following attempted prize notification. Failure to comply with the aforementioned time period may result in forfeiture of the applicable prize. If a potential prize winner is a minor, his or her parent or legal guardian must execute and timely return such documents to Sponsor.
VI. Grand Prize. One (1)
Grand Prize will be awarded in the Contest. The Grand Prize winner will
receive an invitation code to become a RueLaLa member and a $1,000 member account credit redeemable at RueLaLa.com (the “Grand
Prize”). Account registration is required, and membership and redemption
of the account credit are subject to the terms and conditions and privacy
policy of RueLaLa.com.
Finalists
Prize. Each of the top three (3) Finalists
who receive the three (3) highest judges score will receive $100 BagBorrowOrSteal.com Gift Cards. Account
registration may be required. Use of the
BagBorrowOrSteal website and redemption of the gift card are subject to the
terms and conditions and privacy policy of BagBorrowOrSteal.com.
No transfers or substitution of
prizes will be permitted except at the sole discretion of the Sponsor, who
reserves the right to substitute a prize (or portion thereof) of comparable or
greater value.
VII. Winner’s List. The name of the Grand Prize Winner and Finalists will be made available on MyItThings.com upon termination of the Contest.
VII. Limitation of Liability & General Conditions. You acknowledge and agree that the Sponsor of this Contest shall retain worldwide, in perpetuity, all ownership rights to each of your submitted articles and reserves the right to publish, edit, add to, delete, distribute, use, license, duplicate or otherwise exploit in any manner or forum whether now known or hereafter devised each such article in any manner it sees fit and no compensation shall be owed to you resulting therefrom.
Where permitted by law, by entering the Contest, you agree to the Sponsor’s (and those acting pursuant to Sponsor’s direction of control) right to use to your name, picture, likeness, biographical information and article(s) submitted (whether in whole or in part) for advertising, and promotional purposes, worldwide, in perpetuity, in print, broadcast and in any media now known or hereafter developed, including the Internet, without additional consideration and without notification, review or approval, except where prohibited by law.
Participants, or if minors, their parents or legal guardians, further agree to release, indemnify and hold harmless Sponsor, administrator(s), judges, affiliates, advertising and promotional agencies, and each of their respective directors, employees, representatives and agents (collectively, “Releasees”), from and against any and all liability for any injuries, loss or damage of any kind, arising in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of any prize, participation in the Contest or participation in any Contest related activity. Releasees are not responsible for technical, computer, mechanical, printing, typographical, human or other errors or omissions relating to or which may arise in connection with the Contest including, without limitation, errors which may occur in connection with the submission of articles, the administration of the Contest, the announcement of the Grand Prize or Finalists; or for stolen, lost, late, misdirected, damaged, incomplete, inaccurate, undelivered, delayed or illegible entries.
The
Sponsor reserves the right, at its sole discretion, to disqualify any
individual it determines, in its sole discretion, has tampered with the entry
process or the operation of the Contest in any manner or is in violation with
these Rules. In the event that Sponsor, in its sole discretion, finds
that the Contest is compromised, becomes corrupted in any way or is not capable
of running as planned due to unauthorized intervention, fraud, technical
failures or any other causes which affect the administration, security,
fairness, integrity or proper conduct of the Contest, as determined by the
Sponsor in its sole discretion, the Sponsor reserves the right to cancel,
terminate, modify or suspend the Contest in whole or in part.
As
a condition of entering the Contest, participants, or if a minor, their parents
or legal guardians, agree that under no circumstances will participants be
permitted to obtain awards for, and participants hereby waive all rights to
claim, punitive, incidental, consequential, or any other damages, other than
for actual out-of-pocket expenses; all causes of action arising out of or
connected with the Contest or any prize awarded shall be resolved individually,
without resort to any form of class action; and any and all claims, judgments
and awards shall be limited to actual out-of-pocket costs incurred and in no
event shall participant be entitled to receive attorneys’ fees or other legal
costs.
